The NLRB, Sutter, and the Union reached a settlement agreement regarding the Unfair Labor Practice Complaint issued by the NLRB which alleged that Sutter unlawfully failed to give notice and an opportunity to bargain over its use of traveling nurses at the Mountain View and Sunnyvale Oncology Clinics. The settlement includes these significant wins for the Mountain View and Sunnyvale Units represented by ESC Local 20: 

  • Going forward, Sutter agrees to give notice to the Union and engage in bargaining on the use of Travelers as required by law. 
  • Sutter agrees to rescind any or all unilateral changes to your terms and conditions of employment concerning the use of traveling nurses to cover vacancies in the Oncology Department
  • Sutter agrees to not interfere with your rights to join and participate in your Union.
  • Sutter agrees that within 14 days of the settlement date, it will pay $7,000+, split evenly among all RNs in the Unit, to remedy the harm caused by Sutter’s actions.
